Shop Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of the Smeuse Shop and your purchase of products from Smeuse Studio LLC (“Smeuse Studio,” “Smeuse,” “we,” “us,” or “our”). By accessing the shop, creating an account, or purchasing a product, you agree to these Terms.

Digital Products

The Smeuse Shop sells digital products, including but not limited to website templates, social media templates, business templates, guides, workbooks, and other downloadable or digitally delivered resources.

No physical product will be shipped unless expressly stated on the applicable product page.

DIY Products and Customization

Unless expressly stated otherwise on the product page, all products sold through the Smeuse Shop are DIY digital products.

Your purchase does not include customization, installation, implementation, setup, design services, copywriting, technical support, or other done-for-you services by Smeuse Studio.

You are responsible for customizing and implementing your purchased product, including replacing sample content, imagery, colors, fonts, copy, links, and other elements as applicable.

Any examples, demonstrations, tutorials, or instructional materials included with a product are provided to help you use the product yourself and do not constitute an agreement for Smeuse Studio to customize or implement the product on your behalf.

If you would like Smeuse Studio to customize a product or provide additional design or website services, those services must be purchased separately and are subject to separate availability, pricing, scope, and service terms.

Purchases and Payment

Prices are displayed in U.S. dollars unless otherwise stated. Payment is due at the time of purchase and is processed through the payment methods made available at checkout.

You agree to provide current, complete, and accurate purchase and account information when placing an order.

We reserve the right to correct pricing or product information errors and to cancel or refuse an order when reasonably necessary, including in cases of suspected fraud, unauthorized transactions, pricing errors, or misuse of the shop.

Digital Delivery

Digital products are generally made available after successful payment through the download link, customer account, confirmation email, or other delivery method described at checkout.

You are responsible for providing an accurate email address and maintaining access to the email account used for your purchase.

If you experience a legitimate problem accessing a purchased product, please contact us for assistance.

Refunds

Due to the immediate and digital nature of our products, all sales are final unless otherwise required by applicable law.

We do not offer refunds, returns, or exchanges because you changed your mind, purchased the wrong product, no longer need the product, or failed to review the product description or requirements before purchasing.

If you experience a technical issue with a file or believe you received the incorrect product, please contact us so we can help resolve the issue.

Licensing and Permitted Use

Your purchase grants you a limited, non-exclusive, non-transferable license to use the product according to the license terms provided with that product.

Unless expressly stated otherwise, products purchased from the Smeuse Shop are licensed for use by one business or brand.

You may customize purchased products for your own permitted business use.

You may not resell, redistribute, sublicense, share, reproduce for commercial resale, or otherwise make the original product or substantially similar derivative product available to another person or business.

You may not claim a Smeuse product, template, or its underlying design as your own original template or product for resale.

Additional license terms included with a particular product are incorporated into these Terms.

Third-Party Platforms, Software, and Assets

Some products may be designed for or require third-party platforms or services, such as Showit, Canva, WordPress, Google, or other software.

Your purchase does not include third-party subscriptions, licenses, fonts, stock imagery, software, hosting, domains, or other services unless the product description specifically says otherwise.

We are not responsible for changes, outages, discontinued features, pricing changes, or other actions taken by third-party platforms.

You are responsible for maintaining the accounts, subscriptions, software, and technical requirements necessary to use your purchased product. Smeuse Studio is not responsible for installing, configuring, or maintaining third-party platforms or services as part of your Shop purchase unless expressly stated otherwise.

Intellectual Property

The Smeuse Shop and its original products, designs, graphics, written materials, templates, branding, and other content are owned by or licensed to Smeuse Studio LLC and are protected by applicable intellectual property laws.

Purchasing a product does not transfer ownership of our intellectual property to you.

Customer Accounts

You may have the option to create an account to access order information or digital downloads.

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. Please notify us if you believe your account has been accessed without authorization.

Results and Professional Advice

Our products are intended to provide creative, educational, organizational, or business resources. We do not guarantee any particular business, financial, marketing, SEO, sales, or other result from using a product.

Nothing sold through the Smeuse Shop constitutes legal, financial, tax, or other regulated professional advice.

Website Availability

We try to keep the shop and purchased resources available and functioning properly, but we cannot guarantee uninterrupted or error-free access.

We may update, modify, discontinue, or temporarily restrict portions of the shop when reasonably necessary.

Limitation of Liability

To the fullest extent permitted by applicable law, Smeuse Studio LLC will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of the shop or purchased digital products.

To the fullest extent permitted by law, our total liability relating to a particular purchase will not exceed the amount you paid to Smeuse Studio for the product giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

Privacy

Your use of the Smeuse Shop is also subject to our Privacy Policy, which explains how we collect, use, and protect personal information.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last Updated” date.
